These Terms of Service (“Terms”) govern your use of the website and services provided by Barre 2.0, a brand operated by Evolved Movement Pty Ltd (ACN 682 571 017) (“we”, “us”, or “our”), including all training programs, workshops, memberships, digital products, and any related content delivered via www.barre2point0.com (“Website”).

By accessing our Website or enrolling in any of our services, you agree to be bound by these Terms. If you do not agree, please do not use our Website or services.

1. Eligibility

You must be at least 16 years old to create an account and access our paid services.

2. Accuracy of Information

You agree that all registration and personal information you provide is accurate, current, and complete. You are responsible for keeping this information updated.

3. Health and Participation

You agree to inform us of any health conditions, injuries, or limitations that may affect your ability to safely participate in our training or workshops. You also agree to exercise within your limits and seek medical advice when necessary. You must inform your teacher immediately if you experience pain, discomfort, dizziness or any symptoms of concern during or after a session.

4. Assumption of Risk and Exercise Waiver

You acknowledge that all physical exercise carries inherent risks, which may include injury, aggravation of pre-existing conditions, muscle strain, fainting, abnormal blood pressure, or adverse cardiovascular events.

By using our services or following our programs, you do so at your own risk. You release Barre 2.0, Evolved Movement, and their affiliates, instructors, officers, and representatives from any and all liability related to your participation in any program or use of information provided through our Website or courses.

If at any time you feel unwell, faint, dizzy, or experience pain, you should stop immediately and seek medical advice.

5. Hands-On Correction (In-Person Courses)

You understand that Barre 2.0 instructors may use hands-on correction as a teaching method during in-person sessions. You consent to this practice unless you advise the instructor otherwise prior to or during the session.

6. Enrolments, Cancellations & Refunds

To cancel your enrolment, please contact us at [email protected]. We will offer a full refund less the cost of payment processing fees charged to us by Stripe or PayPal for cancellations made at least 14 days prior to a course start date.

For cancellations within 14 days of the course start, no refunds will be issued (except as required by Australian Consumer Law). However, you may transfer your enrolment to a future course of equivalent value within 12 months.

If we cancel or reschedule a course, you may choose to transfer or receive a full refund.

7. Payments

All services must be paid for in full at the time of purchase. We accept payments via credit card, debit card, and PayPal through our secure checkout system.

8. Subscriptions

Some Barre 2.0 services may be offered via subscription (e.g. membership access). Subscriptions automatically renew unless cancelled. You may cancel your subscription at any time before your next billing date to avoid further charges.

9. Intellectual Property

All content on the Website and in our materials, including videos, manuals, downloads, graphics, branding, and course content, is the property of Barre 2.0 or its licensors. You may not reproduce, modify, distribute, share, or resell any materials without our express written permission.

10. Account Security

You are responsible for maintaining the confidentiality of your account login and password. You agree not to share your login with others. We may suspend or terminate accounts suspected of misuse.

11. Image and Video Release

By participating in Barre 2.0 programs or events, you grant us permission to record, photograph or film you. These materials may be used for training, promotional, and commercial purposes.

You waive any right to approve or receive payment for the use of such images or footage.

12. Privacy

We are committed to protecting your privacy. We collect and handle personal information in accordance with the Australian Privacy Act 1988 (Cth), the Australian Privacy Principles, and where applicable, the GDPR.

13. Consumer Guarantees

You agree to indemnify and hold harmless Barre 2.0, Evolved Movement, and their team from any claims, liabilities, costs, or damages resulting from your breach of these Terms or misuse of our services.

These Terms are governed by the laws of Western Australia. Any disputes will be handled by the courts of that jurisdiction.
